1. About us
This website, sonagrocery.co.uk, trading as Sona Grocery, is operated by Sona Retail Limited ("Sona", "we", "us", "our"), a company registered in England and Wales with company number 12463997. Our registered office is Unit 3b Clearwater Industrial Estate, Ettingshall Road, Wolverhampton, England, WV2 2JP. You can contact us at info@sonafoods.co.uk. By using this website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the website.
2. Using our website
You must be at least 18 years old to place an order. You agree to use the website only for lawful purposes, to give accurate and complete information when you order, and not to misuse the website, interfere with its operation, attempt to gain unauthorised access, or introduce anything harmful to it. We may suspend or restrict access to the website at any time, including for maintenance.
3. Products and product information
We try to describe and photograph our products accurately, but images are for illustration only and packaging, labelling and weights may vary from time to time. Please always check the label on the product for ingredients, allergens and use instructions before you use it. Where a product is labelled for a specific use, you should follow the label. Product availability is not guaranteed.
4. Orders and contract
When you place an order, you are making an offer to buy. We will send you an email acknowledging your order, but this is not acceptance. A contract between you and us is formed only when we dispatch your goods, or when we confirm dispatch by email. We may decline or cancel any order, including where a product is unavailable, where there is an error in the price or product information, where we suspect fraud, or where we cannot deliver to your address. If we cancel an order after you have paid, we will refund you in full.
5. Prices and payment
All prices are shown in pounds sterling (GBP) and include VAT where it applies. Prices and offers may change at any time, but the price you pay is the price shown when you place your order. If we discover an obvious pricing error, we may cancel the order and refund you, even if the order has been acknowledged. Payment is taken at checkout through our payment providers. We do not store your full card details. Discount codes and promotions may be withdrawn or changed at any time and are subject to their own conditions.
6. Delivery, returns and refunds
Delivery is subject to our Shipping Policy, and returns and refunds are subject to our Return and Refund Policy. Both form part of these Terms of Service.
7. Your legal rights
If you are a consumer, nothing in these terms affects your statutory rights under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
8. Our responsibility to you
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law. Subject to that, if we breach these terms, we are responsible only for loss or damage that is a foreseeable result of our breach. We are not responsible for loss that was not foreseeable. If you are a consumer, we only supply goods for domestic and private use, and we are not liable for any loss of profit, loss of business, business interruption or loss of business opportunity. If you are a business customer, our total liability to you under or in connection with an order is limited to the price you paid for that order, and we exclude all implied terms, warranties and conditions to the fullest extent permitted by law.
9. Events outside our control
We are not responsible for any delay or failure to perform our obligations where it is caused by an event outside our reasonable control, including carrier delays, supply chain disruption, industrial action, extreme weather, fire, flood, power or IT failure, or government action. If this happens, we will let you know as soon as we reasonably can and take reasonable steps to limit the effect.
10. Intellectual property
All content on this website, including the Sona name, logo, trademarks, text, photographs and design, is owned by or licensed to us and is protected by intellectual property law. You may not copy, reproduce, distribute or use it for commercial purposes without our written permission.
11. Links to other websites
Our website may contain links to third-party websites. We do not control them and are not responsible for their content or practices.
12. Privacy
We handle your personal information as described in our Privacy Policy.
13. Trade and wholesale customers
Orders from businesses, including wholesale orders, are subject to these terms and to any other terms agreed with us in writing, which will take priority if there is a conflict.
14. Changes to these terms
We may update these terms from time to time. The terms in force when you place your order will apply to that order.
15. General
If any part of these terms is found to be unenforceable, the rest will continue to apply. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these terms to anyone else, but we may transfer ours.
16. Governing law
These terms, and any dispute arising from them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the United Kingdom, you may also bring a claim in the courts of the country where you live.
